Understanding Trademark Status

Every trademark application and registration in the USPTO database has a status that indicates where it is in the process. Understanding these statuses is critical for trademark practitioners and business owners.

Common Trademark Statuses

Live/Active Statuses

  • LIVE/REGISTERED: The trademark is registered and in good standing. The owner must file maintenance documents to keep it active.
  • LIVE/PUBLISHED FOR OPPOSITION: The application has been approved by the examining attorney and published in the Official Gazette. Anyone has 30 days to oppose.
  • LIVE/AWAITING EXAMINATION: The application has been filed and is waiting for an examining attorney to review it.
  • LIVE/UNDER EXAMINATION: An examining attorney is actively reviewing the application.

Dead/Inactive Statuses

  • DEAD/ABANDONED: The application was abandoned, typically due to failure to respond to an Office Action or failure to file a Statement of Use.
  • DEAD/CANCELLED: A previously registered mark that was cancelled, usually for failure to file Section 8 declarations.
  • DEAD/EXPIRED: The registration has expired due to non-renewal.

Serial Number vs. Registration Number

The USPTO uses two different numbering systems for trademarks:

  • Attorney of record: Who represents the owner before the USPTO
  • Prosecution history: All documents and Office Actions

Why Check Trademark Status?

  1. Clearance searches: Before adopting a new mark, check if similar marks are still active.

Tips for Trademark Searches

  1. Search both numbers: If you have a registration number, you can also find the serial number and vice versa.
  2. Check document history: The full prosecution history in TSDR shows all Office Actions and responses.
  3. Verify current ownership: Marks can be assigned; always check the current owner, not just the original applicant.
  4. Note the status date: The status date tells you when the status last changed.
