Understanding Trademark Status
Every trademark application and registration in the USPTO database has a status that indicates where it is in the process. Understanding these statuses is critical for trademark practitioners and business owners.
Common Trademark Statuses
Live/Active Statuses
- LIVE/REGISTERED: The trademark is registered and in good standing. The owner must file maintenance documents to keep it active.
- LIVE/PUBLISHED FOR OPPOSITION: The application has been approved by the examining attorney and published in the Official Gazette. Anyone has 30 days to oppose.
- LIVE/AWAITING EXAMINATION: The application has been filed and is waiting for an examining attorney to review it.
- LIVE/UNDER EXAMINATION: An examining attorney is actively reviewing the application.
Dead/Inactive Statuses
- DEAD/ABANDONED: The application was abandoned, typically due to failure to respond to an Office Action or failure to file a Statement of Use.
- DEAD/CANCELLED: A previously registered mark that was cancelled, usually for failure to file Section 8 declarations.
- DEAD/EXPIRED: The registration has expired due to non-renewal.
Serial Number vs. Registration Number
The USPTO uses two different numbering systems for trademarks:
